This privacy policy applies to the AI Image Generator app (hereby referred to as ‘Application’) for mobile devices that was created by Ali Ebrahimi Pourasad (hereby referred to as ‘Service Provider’) as a Freemium service. This service is intended for use ‘AS IS’.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible within the Application unless otherwise defined in this Privacy Policy.

Face Data and Image Processing

The Application processes images, including those that may contain face data, solely to generate AI-enhanced or modified images via Google’s Gemini API. Your images are sent directly from your device to Gemini without passing through or being stored on our servers. Here’s how your data is handled:

Data Sharing: Your images and face data are never shared with third parties except Google’s Gemini API, which is essential for providing the image generation feature.

Third-Party Processing: Uploaded images are sent directly to Gemini for processing. Data handling by Gemini is governed by their API Terms of Service (https://ai.google.dev/gemini-api/terms#paid-services).

Gemini’s Data Usage (as of April 8, 2025): Google does not use uploaded images to train or improve their models. Images are only stored temporarily for policy enforcement and legal compliance. See the Gemini Terms (https://ai.google.dev/gemini-api/terms#paid-services) for updates and full details.

Data Retention: We do not store any images or face data. Images are processed temporarily and discarded after generation. Refer to the Gemini Terms (https://ai.google.dev/gemini-api/terms#paid-services) for details.

No Local Storage: The app does not store your images locally or on our servers. All processing is done via Gemini. See their Terms of Service (https://ai.google.dev/gemini-api/terms#paid-services) for more.

Security: All image transfers to Gemini API are encrypted to protect your data during transmission.

Information Collection and Use

The Application collects information when you download and use it. For a better experience, while using the Application, the Service Provider may require you to provide certain personally identifiable information, including but not limited to:

Images Uploaded
Your device’s Internet Protocol address (e.g. IP address)
The pages of the Application that you visit, the time and date of your visit, the time spent on those pages
The time spent on the Application
The operating system you use on your mobile device

The Application does not gather precise information about the location of your mobile device.

Location Data Usage

The Application collects your device’s location, which helps the Service Provider determine your approximate geographical location and make use of in below ways:

Geolocation Services: The Service Provider utilizes location data to provide features such as personalized content, relevant recommendations, and location-based services.

Analytics and Improvements: Aggregated and anonymized location data helps the Service Provider to analyze user behavior, identify trends, and improve the overall performance and functionality of the Application.

Third-Party Services: Periodically, the Service Provider may transmit anonymized location data to external services. These services assist them in enhancing the Application and optimizing their offerings.

The Service Provider may use the information you provided to contact you from time to time to provide you with important information, required notices and marketing promotions.

Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may employ third-party companies and individuals for the following reasons:

The Service Provider may disclose User Provided and Automatically Collected Information:

Log Data

The Service Provider wants to inform you that whenever you use the Application, in case of an error, they collect data and information (through third-party products) on your device called Log Data. This Log Data may include information such as:

Your device’s Internet Protocol (IP) address
Device name
Operating system version
Application configuration when utilizing the service
The time and date of your use of the service
Other statistics

Links to Other Sites

The Application may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by the Service Provider. Therefore, we strongly advise you to review the Privacy Policy of these websites. The Service Provider has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. If you’d like them to delete User Provided Data that you have provided via the Application, please contact them at stacked_wore0p@icloud.com and they will respond in a reasonable time.

Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discover that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider (stacked_wore0p@icloud.com) so that they will be able to take the necessary actions.

Security

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information they process and maintain. However, please remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and the Service Provider cannot guarantee its absolute security.

Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

Agreement to Terms

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

Service and Pricing

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

Subscription & In-App Purchases

Payment will be charged to your iTunes Account at confirmation of purchase and your subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Your account will be charged for renewal (the amount depends on the plan you select) within 24-hours prior to the end of the current period.

Subscriptions may be managed by the user and auto-renewal may be turned off by going to your iTunes account settings after purchase.

Data Collection and Security

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone’s security features, and may result in the Application not functioning correctly or at all.

Internet and Network Usage

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider’s agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

Limitations of Liability

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider’s responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

Updates and Changes

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

Changes to Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.

We utilize the Gemini API to power some of our application’s features. While we strive to provide the best service, we are not responsible for any errors, inaccuracies, or unavailability stemming from the Gemini API.

Disclaimer: The photo-to-anime conversion results are generated by the Gemini API and may resemble existing anime styles or characters. Any similarity is purely coincidental and unintentional. The generated content is not endorsed by or affiliated with any anime creators, studios, or copyright holders. Users are responsible for ensuring that their use of the generated content complies with applicable copyright laws.

# Usage Limitations

We reserve the right to limit the number of conversions and may change or terminate our services at any time.

IMPORTANT: This application is intended for creative and entertainment purposes only. The conversion feature should NOT be relied upon for legal, financial, or professional advice. Users must exercise caution and verify information from credible sources when necessary.
